These Terms and Conditions (“Terms”) govern your access to and use of the Velior website, including its pages, forms, content, registrations, applications, purchases, and related services.
By using this website, submitting a form or application, making a purchase, or registering for or participating in a Velior activity, you acknowledge that you have read and agree to these Terms. If you do not agree, please do not use the website or participate in the applicable activity.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to submit an application, make a purchase, or participate in an activity requiring registration.
A person under 18 may participate only with the permission and supervision of a parent or legal guardian. Velior may require the parent or guardian to complete registration and sign additional agreements, waivers, or media releases.
2. Purpose of the Website
The Velior website provides information about our brand, events, programs, and opportunities. It may allow visitors to:

Submit model registrations or applications;

Apply for vendor opportunities;

Request sponsorship information;

Register for events or other opportunities;

Purchase tickets, products, or services; and

Contact or communicate with Velior.
Velior may modify, suspend, replace, or discontinue any website feature, program, event, opportunity, or service at any time.
3. Applications and Registrations
Submitting a model registration, vendor application, sponsorship inquiry, event registration, or other form does not guarantee acceptance, representation, employment, participation, placement, compensation, exposure, or any other opportunity.
Velior may accept or decline an application at its discretion, subject to applicable law. We may request additional information, identification, permission, or documentation before making a decision.
You agree to provide accurate, current, and complete information. You may not impersonate another person or submit false, misleading, or unauthorized information, photographs, measurements, qualifications, credentials, or business records.
Accepted applicants or participants may be required to sign a separate agreement, waiver, code of conduct, or release. If a separate written agreement conflicts with these Terms, the separate agreement controls for the applicable activity or relationship.
Submitting an application does not create an employment, agency, partnership, joint-venture, franchise, or exclusive-representation relationship with Velior.
4. Photography, Video, and Media Release
Velior events, castings, productions, photo shoots, vendor markets, sponsored activities, and other programs may be photographed, filmed, livestreamed, or otherwise recorded by Velior or by photographers, videographers, contractors, media representatives, or partners working with Velior.
By registering for, attending, entering, or participating in a Velior activity where photography or recording is disclosed through the registration process, event signage, announcements, or other reasonable notice, you understand and agree that your name, image, likeness, appearance, voice, performance, statements, and participation may be photographed, filmed, recorded, or otherwise captured.
To the fullest extent permitted by law, you grant Velior and its authorized representatives, partners, licensees, successors, and assigns a perpetual, worldwide, royalty-free, transferable, and sublicensable right to:

Photograph, film, record, and otherwise capture your participation;

Use, reproduce, edit, crop, adapt, modify, publish, display, distribute, broadcast, livestream, archive, and create derivative works from those materials;

Combine the materials with text, graphics, music, other images, or other content; and
-
Use the materials as Velior determines appropriate for lawful business, editorial, advertising, marketing, promotional, commercial, social-media, public-relations, educational, archival, and event-related purposes in any current or future format, platform, or medium.
Velior may exercise these rights without additional notice, inspection, approval, attribution, or compensation to you.
You understand that photographs and recordings may appear on Velior’s website, social-media accounts, advertisements, printed materials, press coverage, promotional campaigns, portfolios, presentations, and materials produced with sponsors or business partners.
To the fullest extent permitted by law, you release Velior and its authorized representatives from claims arising from the authorized capture, editing, publication, or use of these materials, including claims based on rights of privacy, publicity, or compensation. This release does not authorize unlawful use or an intentionally false or defamatory portrayal.
Velior owns the photographs, video recordings, audio recordings, and other media created by or on behalf of Velior, subject to any rights expressly granted in a separate written agreement.
If you do not want to be photographed or recorded, you must notify Velior before participating and follow any instructions regarding designated non-recording areas. Velior cannot guarantee exclusion from incidental crowd or background footage at a public or group event.
A parent or legal guardian must authorize the featured or promotional use of an identifiable minor’s image or likeness. Velior may require a separate minor media release.
Models, performers, featured participants, and individuals participating in a dedicated photo or video shoot may also be required to sign a separate model or media release. That separate release will control if its terms differ from this section.
5. Content You Submit
You retain ownership of photographs, videos, logos, written materials, and other content that you independently create and submit through the website.
You grant Velior a nonexclusive, royalty-free license to receive, store, reproduce, and review submitted content as reasonably necessary to:

Process your application or inquiry;

Evaluate your qualifications;

Communicate with you;
-
Administer an event, program, or opportunity;

Maintain necessary business records; and
-
Operate and protect the website.
Submitting independently created content through the website does not automatically authorize Velior to use it in public advertising. Broader commercial or promotional use will require your express consent or a separate agreement.
You represent that you own the submitted content or have permission to provide it and that its submission and authorized use will not violate another person’s copyright, trademark, privacy, publicity, or other rights.
6. Vendor Terms
Vendor applications are subject to availability, review, fees, event requirements, and any separate vendor agreement issued by Velior.
Unless a written agreement states otherwise, vendors operate as independent businesses and are responsible for:

Their products, services, permits, licenses, insurance, taxes, and personnel;

Product safety, quality, labeling, pricing, and legal compliance;

Customer transactions, warranties, refunds, and disputes; and
-
Representations made about their businesses, products, or services.
Approval as a vendor does not mean that Velior endorses or guarantees the vendor or its products or services.
7. Sponsorships and Endorsements
Sponsorship benefits, fees, deliverables, deadlines, approvals, and cancellation terms are governed by a separate written sponsorship agreement.
A sponsorship inquiry, application, or payment does not create a confirmed sponsorship unless Velior accepts and confirms the arrangement in writing.
Sponsors and participants must accurately describe their relationships with Velior. Sponsored content, endorsements, testimonials, complimentary products, and other material connections must be disclosed clearly and conspicuously as required by applicable advertising laws and platform rules.
8. Events, Changes, and Cancellations
Event dates, locations, schedules, participants, programming, vendors, sponsors, and other details may change.
Velior may postpone, relocate, modify, or cancel an event due to circumstances beyond its reasonable control, including severe weather, emergencies, government actions, venue problems, safety concerns, illness, labor disruptions, or technical failures.
Refunds, credits, transfers, and cancellation rights are governed by the policy presented at registration or purchase and any applicable separate agreement. Nothing in these Terms limits rights that cannot legally be waived.
9. Payments
Prices, fees, taxes, payment schedules, and refund terms will be displayed during registration or checkout or included in a separate agreement.
Payments may be processed through Wix or another third-party payment provider. Velior is not responsible for a provider’s separate terms, privacy practices, outages, security incidents, or processing decisions.
You agree to provide accurate payment and billing information and authorize the charges displayed when completing a transaction.
10. Acceptable Use
You may not:

Use the website for fraudulent, unlawful, threatening, or abusive purposes;

Impersonate another person or misrepresent an affiliation with Velior;

Attempt to gain unauthorized access to the website, accounts, servers, or data;

Introduce malware, harmful code, automated scraping tools, or disruptive technology;

Copy, republish, sell, or commercially exploit website content without permission;

Infringe another person’s intellectual-property, privacy, or publicity rights; or
-
Interfere with the website’s security, availability, or operation.
Velior may restrict or terminate access when we reasonably believe these Terms have been violated.
11. Intellectual Property
Except for content belonging to users or third parties, the Velior website and its branding, text, graphics, photographs, videos, designs, and layout are owned by or licensed to Velior and are protected by applicable intellectual-property laws.
You may use the website for personal, noncommercial purposes. No ownership rights are transferred to you. Written permission is required for unauthorized reproduction, distribution, modification, public display, or commercial use.
12. Third-Party Services
The website may contain links to social-media platforms, vendors, sponsors, payment processors, or other third parties. These links are provided for convenience and do not necessarily constitute an endorsement.
Velior does not control and is not responsible for third-party content, services, products, privacy practices, security, or availability. Your dealings with a third party are between you and that party.
13. Privacy and Communications
Velior’s collection and use of personal information are described in the Privacy Policy posted on this website.
By submitting a form, you agree to receive communications reasonably necessary to process your application, inquiry, registration, purchase, or participation.
Agreement to these Terms does not automatically enroll you in optional marketing communications. Where required, marketing consent will be requested separately. You may unsubscribe from marketing messages using the instructions provided in those communications.
14. Disclaimer of Warranties
To the fullest extent permitted by law, the website and its content are provided “as is” and “as available.”
Velior does not guarantee that the website will always be available, uninterrupted, secure, accurate, complete, or free of errors or harmful components. We do not guarantee that use of the website or submission of an application will produce any particular professional, promotional, financial, or business result.
Nothing on the website constitutes legal, financial, employment, career, or other professional advice.
15. Limitation of Liability
To the fullest extent permitted by law, Velior and its owners, officers, employees, contractors, representatives, and affiliates will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, opportunities, data, reputation, or business, arising from the website or these Terms.
16. Indemnification
To the fullest extent permitted by law, you agree to defend, indemnify, and hold harmless Velior and its owners, officers, employees, contractors, representatives, and affiliates from claims, liabilities, damages, losses, and reasonable legal expenses arising from:

Your unlawful or unauthorized use of the website;

Your violation of these Terms;

Your violation of another person’s rights.
This section does not require indemnification where prohibited by law.
17. Governing Law and Disputes
These Terms are governed by the laws of the state in which Velior maintains its principal place of business, without regard to conflict-of-law rules.
Any legal action relating to these Terms or the website must be brought in a court serving the county in which Velior maintains its principal place of business, except where applicable law provides otherwise.
Before filing a claim, the parties are encouraged to attempt to resolve the matter informally by submitting written notice through Velior’s website contact page.
18. Changes to These Terms
Velior may update these Terms to reflect changes to the website, services, business practices, or applicable requirements. Updated Terms will be posted on this page with a revised “Last Updated” date.
Changes apply after posting unless applicable law requires additional notice or consent. Your continued use of the website after an update constitutes acceptance of the revised Terms.
19. Severability and No Waiver
If any provision is found unenforceable, it will be modified only to the extent necessary or removed, and the remaining provisions will remain effective.
Velior’s failure to enforce a provision does not waive the right to enforce it later.
20. Entire Agreement
These Terms, the Privacy Policy, policies displayed during registration or checkout, and any applicable separate written agreement constitute the complete agreement concerning the relevant website use, transaction, event, or relationship.
